1. Beta Test Program Overview
You ("Beta Tester") agree to participate in the beta testing program for MyAxSpa App ("Product"), a healthcare and lifestyle application/service currently in development by Sam Fusco ("Company").
2. Acknowledgment of Beta Status
2.1 You acknowledge that the Product is in development and may contain bugs, errors, or incomplete features.
2.2 The Product is provided "AS IS" without warranties of any kind, express or implied.
2.3 Features may change or be removed without notice during the beta period.
3. No Medical Advice
3.1 The Product is not intended to provide medical advice, diagnosis, or treatment.
3.2 You should consult qualified healthcare professionals for medical decisions.
3.3 Do not rely solely on the Product for health-related decisions.
4. Assumption of Risk
4.1 You participate voluntarily and at your own risk.
4.2 You acknowledge that using beta software may result in data loss, system issues, or unexpected behavior.
4.3 The Company is not liable for any harm, injury, or damages arising from your participation.
5. Data and Privacy
5.1 You consent to the collection and use of feedback, usage data, and other information for product development.
5.2 The Company will handle your data in accordance with applicable privacy laws.
5.3 Beta data may be deleted or reset at any time without notice.
6. Confidentiality
6.1 All information about the Product, including features, designs, and your participation, is confidential.
6.2 You agree not to disclose, share, or discuss the Product publicly without prior written consent.
6.3 You will not share screenshots, recordings, or other materials from the beta test.
7. Feedback and Intellectual Property
7.1 Any feedback, suggestions, or ideas you provide become the property of the Company.
7.2 The Company may use your feedback without compensation or attribution.
7.3 You retain no rights to any improvements made based on your feedback.
8. No Compensation
8.1 Participation in beta testing is voluntary and unpaid.
8.2 The Company may, at its discretion, provide nominal incentives (such as gift cards) for specific feedback sessions, but you are not entitled to any compensation as a condition of participation.
9. Termination
9.1 Either party may terminate your participation at any time without notice.
9.2 Upon termination, you must cease using the Product and delete all related materials.
9.3 Confidentiality obligations survive termination.
10. Limitation of Liability
10.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES.
10.2 THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT PAID BY YOU (IF ANY).
11. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your participation or breach of these terms.
12. Modifications
The Company may modify these terms at any time. Continued participation constitutes acceptance of modified terms.
13. Acceptance
By participating in the beta test, you acknowledge that you have read, understood, and agree to these terms.
